Attorneys Must Appear On Camera for Virtual Hearings
by Rosalind Asch-Hobeck
The Workers’ Compensation Board has issued clear guidance regarding attorney conduct and participation during virtual hearings. Legal representatives are expected to appear on camera, with their face fully visible throughout the proceeding. Professional attire appropriate for a courtroom setting is required.
Attorneys may participate in only one virtual hearing at a time. If using a mobile device, it is strongly recommended to secure it on a tripod or similarly stable setup to ensure a steady video feed.
The attorney's physical location must be “suitable and appropriate” for a legal proceeding—quiet, private, and free of background noise or visual distractions.
If an attorney encounters a technical issue or any circumstance that may prevent full compliance with these requirements, they must promptly notify the presiding Judge to request an exception or accommodation.
